Terms of Use


Please read these terms of use carefully. By using the ecocloud you agree you have read these terms and agree to be bound and abide by them. We reserve our right to modify these terms at any time.


DEFINITIONS

User (“you”, “your”) means a person who uses or accesses ecocloud, whether in Australia or not, and may include students, researchers or members of industry.


1. USE OF SERVICES

  1. Subject to these terms and conditions, you will be given access to the Services for the Allocation Period.

  2. You agree that this Agreement will become legally binding when you click the ‘I accept’ button, or when you otherwise begin using ecocloud. you acknowledge that you have read this Agreement, understand it, and have had the opportunity to seek independent legal advice prior to entering-into it (if you consider that necessary).

  3. You warrant that you are solely responsible for abiding by any Internal Policies which are relevant to your use of the Services.

  4. If you are entering into this Agreement on behalf of an organisation or institution, you represent and warrant that you have the legal authority to do so, and to bind that organisation or institution to the terms of this Agreement.

  5. As the operator of the ecocloud, we grant you a non-exclusive, non-transferable, non-sublicensable licence to access, view and use the ecocloud in accordance with the terms of this Agreement. You acknowledge that we may revoke your licence to use the ecocloud at any time, in accordance with the terms in this Agreement.

  6. When using or accessing the Services, you are responsible for ensuring that you:

    1. comply with all applicable laws, regulations, codes and guidelines, including the Australian Code for the Responsible Conduct of Research;

    2. regularly back-up your data or configuration;

    3. not use or access the Services:

      1. to engage in fraudulent behaviour;

      2. to defame, harass or engage in any form of unsolicited communications with any third party;

      3. in a manner that breaches the privacy of a third party; or

      4. in a manner that infringes the copyright, moral rights or any intellectual property rights of any third party, including third-party software licenses or service agreements; or

      5. to a degree that unreasonably affects other Users or co-located infrastructure.

  7. For the avoidance of any doubt, you acknowledge that you will not acquire any intellectual property ownership rights in the ecocloud pursuant to your use of it. All intellectual property rights in the ecocloud are retained by us and our members.


2. THIRD PARTY USE OF SERVICES

  1. You are solely responsible for your use of the Services and must not provide your credentials to a third party.

  2. You must notify QCIF immediately if you notice any breach of security or unauthorised use of your user account.


3. EXPIRY, LIMITATION, SUSPENSION OR TERMINATION

  1. Upon expiry of your Allocation Period, your access to the Services will cease and any data or virtual environments created by you will be deleted. It is your responsibility to maintain backups of any data or virtual environments created by you.

  2. At any time prior to the expiry of your Allocation Period, ecocloud may:

    1. limit, attenuate, suspend or terminate your use of the ecocloud at any time, at its discretion and without notice; or

    2. immediately remove any content on the ecocloud, including any virtual environment you create or contribute to, in any of the following circumstances:

      1. inappropriate use of the ecocloud or any of its Services;

      2. a detected vulnerability or compromise in the security of the Services;

      3. a request or direction by a law enforcement agency; or

      4. QCIF reasonably determines that there is an operational need for the content to be removed.


4. LIABILITY

  1. ecocloud is provided on an ‘as-is’ basis. Your use of the ecocloud is at your sole risk.

  2. To the extent permitted by law, QCIF gives no guarantee, warranty or representation in relation to the Services, including in relation to the availability, fitness of purpose, or maintenance and security.

  3. QCIF gives no guarantee and accepts no responsibility for the integrity, value, reliability, accuracy and completeness of the content hosted on the ecocloud, or the actions of third parties (including users of the ecocloud). You agree to independently verify the accuracy, currency and completeness of any information obtained through the ecocloud. You agree that we will not be liable to you or anyone else for any decision made, or action taken, in reliance upon any information obtained through the ecocloud. 

  4. QCIF does not accept responsibility for or endorse the content or condition of any linked or third party site.


5. DERIVED DATA

  1. If you use the ecocloud to generate Derived Data, you will own all right, title and interest in such data. 


6. PRIVACY

  1. You agree and acknowledge that the personal information you provide is being collected by QCIF, and will be used by authorised staff to monitor, and report on, the use and security of its services. Information about your use of ecocloud may be disclosed to your organisation and any funding entity, including the Australian Commonwealth.

  2. You may access any personal information you have provided to QCIF by emailing the QCIF helpdesk at ?. QCIF is committed to protecting personal information provided by you in accordance with all applicable privacy legislation.


7. ATTRIBUTION

  1. If you use ecocloud to conduct analyses you will attribute is as 'ecocloud Platform, accessed DD/MM/YY.'
